I would like to but my mom does not want me to and I do not want to disrespect her. I take Isabella everywhere with me and she is always at my moms with us when we go there. My mom won't let me put her in her backyard because she's afraid her dogs might squash her because she is so little ( 7 lbs) so I just would have thought my mom would be more understanding and supportive. Not to mention it happened on Christmas day and we all know how broke we get around the holidays especially if you have children like I do, 1 13yr old and 1 8 yr old, so although it was NEVER an option not to take her to the ER or have the surgery it is killing the pocket book! I would have thought she would understand that. My mom is crazy about animals, everyone in our family says they want to be reincarnated as a dog or cat and live at my mom's. Last winter she built her dogs a $3000 dollar HUGE dog house and for christmas her & my Dad built a huge dog house about 12 x 15 for my big dogs, with a roof and all, even though my big dogs are indoor/outdoor dogs and sleep inside everynight she said they needed a big house for the rain and winter during the day instead of their regular dog houses. I guess that is why I am upset with her because as crazy as she is about dogs, and trust me she is wayyyyyy over the top I thought she would be a little more sympathetic!

I did not post to get rude or insensitive comments posted. I am a very responsible pet owner and this was an unfortunate accident and I know that. No one on here will ever understand how I am about my pets and I can not handle the insensitive comments on here, I feel like someone is stabbing me in the chest. I obviously know you don't let a female in heat run free and that was not the case here. I guess If I would have posted "Neighbors dog roaming the streets injured my dog" there would have been a totally different response. Why people are only focusing on the fact that my dog is not fixed is beyond me, If she was not in heat and he came onto the property and pounced on her beacuse he wanted to play or wanted to fight would it be ok then? PLease no more post, Some of you have had me in tears and made me feel even more horrible than I already feel. I just hope no one else has their pet injured by another animal roaming freely regardless of the reason.
What a horrible thing to happen! And I did get that you won't talk to the male dog's owner on your own because your mom doesn't want you to, and that you're deferring to her wishes because she's the one who has to live there. Maybe once your mom hears how much the hip replacement surgery will cost, she'll reconsider. Does she know the owner, or is she just assuming the worst? If the owner is even a half-decent sort he'd rather know directly than have it get back to him through neighborhood grapevine.
Maybe even without leash laws, a dog's owner is responsible for damage the dog does on someone else's property, especially if the dog wasn't an invited guest. If that dog had damaged something inanimate, the liability wouldn't even be questioned. But aren't you looking at a couple thousand dollars for the surgery? The owner of the male dog might actually have homeowners insurance that would cover the vet costs. I hope your mother reconsiders, and that the neighbor steps up. A Small Claims Court judge would probably say he should pay half, assuming both sides were found contributing liability. Maybe more than half since it happened on your mother's lawn. Most lawyers who handle torts will not charge for the initial conversation, and will take their fee only from what you'd win in a settlement or judgment.
Well if you take her to your moms again-fixed or not-I suggest you have your mom put her dogs in while you let yours go to the bathroom. Why was that so hard-are they only outside dogs?
Yes her dogs are only outside dogs, They have never been trained to be inside and only come in for short periods when it is very very cold at night. Not to mention she has an indoor cat that is terrified of big dogs and her dog attacked it once before, so if the dogs are in the cat is locked up.
1. when you post on a public forum you are gonna get all kinds of responses. So you like some you don't.
2. just because it took you 8 hrs to realize she was in heat does not mean she wasn't when this dog tried to mount her. Females coming in heat for 7 day, bleed for 7 days and spend 7 days going out of him. At any of those times a male can try to mate her.
3. second I am sorry your dog got hurt. But if your mom is not gonna talk to these people you are gonna have to. That is if you wanna try to get them to help pay. If you don't plan to talk to them and ask them to help pay you kinda have to move on. As insensitive as that is you either tell them and hope for the best or don't tell them move on and hope for the best.
There is no reason to be upset. I have read through the posts and really don't see where anyone has been rude to you. You asked for opinions in your first post and that is what you got. Take them or leave them, it is up to you.
Perhaps your Mom can crate up her dogs so that your little dog can go in the fenced in back yard to relieve herself. Does she have a garage or a basement, her dogs could go in there for the duration that you are visiting or just for your dog to go outdoors.
Re-reading through the posts here, the jest is, you are somewhat responsible for what happened here. We are all sorry that the dog was injured, I am sure that no one here is celebrating that your dog has had to go through pain and surgery. I don't see anyone laughing or joking about your dogs injury. I do see people that are passionate about animals (especially dogs) and are trying to offer you suggestions to prevent such a mishap in the future.
Again, there is nothing to be upset over, perhaps you are just emotional because of all you have gone through the past 24 hours.
I asked for advice on what to do with the issue of telling the owners. Not wheter or not I should have let her go outside or whether or not I should have a unfixed female. Nor have I ever said anyhting about being rude or asking them to help pay. I simply said maybe if they knew they would do the right thing and offer to pay HALF,not all of the bill. I never said I wanted them to take full responsibility, I take responsibility for my part as well. I am sorry I now have a different view bout this sight. I only got 2 or 3 responses on advice about what to do about the owners, everything else has been about whether or night i should have had her outside,on a leash etc...... Thanks Anyways!
I think Chrissytr was hoping for some sympathy on how unsupportive her mom is being throughout this. Sounds to me like mom is being a royal pain. Especially since her mom has it set up so there's no outdoor fenced place where her Pom can use the yard when she has to. Visits can be really hard when you can't bring your dog along, especially during the holidays when it's hard to find kennel boarding space, and especially when you're supposedly going to a pet-friendly home. I would be more accommodating to my own kid for sure.

i would be very mad if this happend to my female. i feel if my dog is on my property she doesnt need to be on a leash. i feel and though that a leash law is for when you leave your property and go out in public? i know if the neigbors dog came bolting over to our yard to get my female i surly would be taking it up with my state trooper neighbor. and i feel that he would be liable for any injuries. i will have to ask my cop neighbor that if something like this happens who is at fault? i know he donest ever has his dog on a leash not even walking down our private road-
why should i have to have my dog on a leash in my yard if i can control my dog? ( yes daisy has made a few trips to the cop neighbors houes to bark at the rock but she didnt do it today so i hope were done with that crazt stuff) so if she ran over to their yard and his dog went after my female then yes it would be my fault but if im in my own yard i would think it was who evers dog it was/ im going to go ask my state trooper neighbor about the leash law and if you have to have your dog on a leash in your own yard. he will know. he told us that really we had no case about going ater the puppy mill for selling us a sick pup- we could go to small claims court but really there was nothing esle that could be done-
If there are no leash laws, and you're going to complain about the -other- dog being off leash.. perhaps YOURS should have been on a leash as well. Personally, I find this to be your problem. If your dog was in heat, she should have been on a leash.. right by your side.. or be FIXED. Period.
My take of this is that yes, she probably should have had her in heat dog on a leash. However, that does not take away the fact that this other dog was off leash on someone elses property. Even areas with a leash law allow people to have their own dogs unleashed on their own property. If she had her Pom on a leash, and picked it up and the dog knocked her down and caused injury, isn't it still the roaming dogs owners fault?
If the dog was not in heat and this other dog came onto private property and caused damage, wouldn't everyone agree the roaming dogs owner was responsible? What difference does it make if the dog was in heat or not?
I hope your Pom will be ok. And only you can decide if you want to go against your Mom's wishes file a complaint or go to small claims court. Do you have any witnesses?
