At this point my issue is that she will not surrender the dog...that is wrong. The evidence will speak for itself when presented in court. But she is still in the wrong by not surrendering what is not legally hers...for whatever reason she may have...

The owners will never be charged/convicted of anything if the dog is not turned over and evaluated by a vet of the court's choosing. Pictures and video are great but the court will want hands on that dog and make their own determination.

Believe me, I sympathize with everyone on this and can see the reson why it was done. I can't say what I would have done because I am expected to uphold/enforce the laws...but rest assured the temptation would be there.
