I'm new to this site, and would appreciate any advice....
I lost my dog 2 months ago to the ParvoVirus. He was only 9 weeks old. My husband and I bought him from a puppy store (yes yes...first mistake)...
We brought our dog home on a Monday night. By Tuesday, he started showing signs of the ParvoVirus. We had to put him to sleep on that Saturday, because he was in so much pain in agony. We took him to the vet on Wednesday, Thursday, Friday and Saturday, but nothing helped. The thing is...our dog arrived at the puppy store 2 days before we bought him...which means that the breeder is liable for my puppy contracting the ParvoVirus, because it takes 7-10 days to show signs of the virus.
Ugh...the more I think about it, the more I want to sue the Breeder. Have any of you done this, or have known anyone to do this??
There are some pretty seasoned people that can help you out on this topic.
Let me give you my 2 cents of what I know.
I'm not sure what state your in - But here in california they have a pet lemon law that protects you when this happens. You should get a full refund of the purchase price of your puppy plus the medical bills should be reimbursed up to the cost of what you paid for the pet (I'd have to look to be 100% sure on the medical bill part, but I'm pretty sure thats accurate, as far as how much the med bills are covered up to).
Others here will be a great help... just hold tight. Look up your states pet lemon laws in the meantime.
I'm soo sorry for your loss, that is terrible. I am not sure what state you live in but I thought if a breeder sells to a pet store that they cannot be held liable. Not sure though. It really sucks I think but someone should be held responsible for selling the puppy in poor health. What were some of the signs? if you don't mind.
So sorry for your loss, there are lemon laws for dogs by state. I am thinking, however, the breeder is not responsible once it is sold to the shop and they accept ownership. It is the responsibility of the pet shop (whose hands owned the pup at the time of your purchase) to get a medical clearance before selling. The shops "should" hold pups for "x" # days before selling to assure health, but they don't
I believe you should be entitled to a full refund with possible reimbursement of the vets bills by the shop that sold it to you. Of course, this may vary by state.
I wish I could be of of help, but all I can say is that I'm sorry for your loss. I know how you feel. I lost a puppy I rescued from a Shelter due to Distemper. It always hurts when you have to put a dog down, but it hurts even more when it's just a poor little puppy.
You might not have a case because the defendants can argue that you didn't have to put the dog down. Many puppies with parvo get treated and survive. It is an expensive process. They can argue that you chose to put him down. I am not saying I agree with either party. I am just stating the facts.
