Due to a Barron's Educational Series, Inc being "Money Greedy" we had to remove their books information from our website. The amount of money they were asking for ($2500/year) was out of any pet information websites budget. They said the author had to be fairly compensated. We agreed the author must be compensated so we made an offer and they would not accept nothing lower then $2500/year. We only used less then 10% of the information provided about each breed. NOTE: Before we started using the information we contacted the author, who wished us good luck with our website. Now the author wants a piece after we have become one of the biggest dog website. Not only does she want a piece, she wants to be back paid from the beginning. Isn't she a nice author.
Oh.... If you haven't noticed we just removed the sponsor ads and popup ads in the last couple days, because we finally reached budget to do all the upgrades. If we paid the author that amount every year we would have to keep a couple popup ads running year round.
Getting all the links for every breed club is the hard part. We are probably going to allow people to submit information about their breeds and have our own information. We would still like to link the national breed clubs.
Thanks everyone for your emails on the national breed club lists, it will be great help to us. onehappygirl, Please let us know what she says! We have been dealing directly with the Rights Manager of Barron's. We haven't emailed her directly since she wished us good luck on the website.
My husband owns a business with my father. People do change prices when they see the value go up. I really don't see this as stealing if there was consent to post information. It also appears that the author wanted more money when she saw the pot get richer.
SuperMommy, We did not pay for the information to start with, we just referenced the material. We contacted the author before even using the information, that is when she wished us good luck with the website.
HeatherB, Q. "You make money off this site, right?" A. Not really, this website pays for itself. We do it for the love we have for dogs, not money. Our company (JCOM Designs, LLC) survives off our real estate software. Q. "It's a business proposition for you, no?" A. They tried to sell us rights to use upto 25% of the book or nothing. Q. "You had to pay for computers, software, programmers, etc., and you're paying still for your business expenses." A. True Q. "Dr. ***** has expenses, too. She is a professional writer, and a respected, award-winning one at that." A. We never said she wasn't a respected writer. Q. "She deserves to get paid for her work, and yet you thought nothing of taking her work without permission or payment and posting it on your site." A. As we stated earlier, we contacted her asking to use some information from hr book before even using the information from the book. That is when she wished our site good luck. We have proof, we keep every email every sent to us. Q. "And now, because her publisher called you on it and asked you to PAY for what you STOLE, you're calling her greedy because her publisher wouldn't give the material you stole to you at what little you're willing to pay?" A. HELLO, how do you know what we offered? We offered her $1,250/year, plus we have been promoting her book to millions of people. That is what we can afford, we only used about 10% of the information for each breed. Q. "You owe her an apology, at the very least. Take down your shameful remarks, and take down her work unless and until you are willing to pay a fair price for it." A. She owes us an apology! Her information has been down since this morning. The remarks will stay up, we have been totally open with everyone and it will stay that way. Q. "She never tried to to sell you her work, or up the ante as another poster has said. " A. What do you call it then? The Rights Manager told us directly that the author needed to be compensated! We agreed that the author should start being compensated, but $2500/year is overboard. You sure do know a lot about this, who are you really? Your located in Sacramento, CA!
I am very disappointed in the integrity of this site. Wishing you luck with a site doesn't mean giving you permission to use my work. I referred you to the Barron's site for permisson, since they own the copyright, as printed in the book. I cannot legally assign it to you. You said you would contact them, and I took you at your word. You apparently chose not to contact them but to go ahead and use the material. This is not promoting my book, by the way; in fact, today is the first time I've ever seen my name mentioned on your site. To my knowledge your source material was never referenced, and still is not for the parts of my book you still have up. I wish everything in life were free. I wish people could advertise on your site for free, but I understand you charge them. I wish the breeders could give away their puppies for free (well, actually I don't, but...) I expect all your advertisers charge for puppies. I wish pet supplies were free, dog supplies, veterinary care, schooling..but it's not. I wish I could get my reference books for free, my journals, my education--but I can't. I wish I had no bills---but I do. I support myself and my dogs solely with income from writing fulltime---7 days a week, 12-16 hours a day. I suggest your readers go to one of the sites that followed the law, contacted Barron's, and paid a fee. Please visit http://animal.discovery.com/guides/dogs/selector/selector.jsp or www.ivillage.com or www.K9info.com When a site such a terrificpets uses the same material without paying, they are stealing not only from me and my publisher, but from these legitimate sites that paid for the material terrificpets seems to feel entitled to for free. Better yet, visit www.amazon.com and buy the book! Be on the lookout for the 2nd edition due out in 2005. I have spent the last several months working every day for 16 hours a day on it, contacting representatives from every parent club, compiling the very newest health information, updating breed histories, and fine-tuning everything. I could have just slapped new photos in it but I wanted this to be even more helpful than the 1st edition has been to people. Guess what? I don't make a penny from this effort. At least, not until somebody actually pays for a book or for the rights to use the material. In summary: I never gave you permission to use any of my work. You are in violation of copyright law. You are stealing, and most amazingly of all, you are blaming the victim. I hope your readers will access the same information legally elsewhere. D. Caroline Coile, Ph.D.
We did not refuse to pay you for your information as stated. Our website can not afford the $2500/year. Yes we do charge for some advertisements but that only keeps this website on the internet. The websites you listed are huge companies that can afford that price! We offered what we could afford $1,250/year plus we had a direct link to the publishing companies website so they could BUY the book. Which is HOW you make your money! That link is placed in front of MILLIONS of people!
